Sadsbury Township Planning Commission, November 15, 2017

The Sadsbury Township Planning Commission meeting was held on Wednesday, October 11, 2017 commencing at 7:00 p.m. Chairman, Ms. Heineman called the meeting to order.  Present were members, Tim Sarbaum, Ron Yen, John Lymberis, and Carlyle Rivers.  Also present was Supervisors Liaison, Mr. Hensel and Building/Zoning Officer, Mr. Lowry, and Township Manager, Mr. Walters.

A moment of silence and Pledge of Allegiance were observed.

John Lymberis made a motion, seconded by Carlyle Rivers, to approve the October 2017 meeting minutes.  With there being no questions, the members voting “aye”, the motion passed unanimously.

Eric Carlson, from Arcadia Land Company came before the Planning Commission seeking a request from the Planning Commission to the Board of Supervisors to approve the revised plan for Phase 4A & 4B of Sadsbury Park.  Mr. Carlson responded to the October 23, 2017 review letter from MacCombie Engineers.  Mr. Carlson stated that in the letter under Zoning Code, #1 – the proposed revisions to the TND Ordinance to accommodate the construction of Ranch-style homes did receive approval from the Board of Supervisors.  A lighting professional will be used for the lighting in the development.  An updated letter of Adequacy will be sent to the Conservation District.  Mr. Carlson stated he does not agree with 6(e) on the MacCombie letter recommending that since N. Harner Blvd. has been extended from Scantlen St. to Shoemaker St., the sidewalk be extended as well along the south side of N. Harner Blvd.  Mr. Carlson responded to the review letter from the Chester County Planning Commission dated November 1, 2017.  Issue #5 suggests opportunities for pedestrian access, using sidewalks, from this site and its surroundings to the Sadsburyville area to the north. Mr. Carlson stated there will be a pedestrian walking trail to Greenhill Road.

Mr. Lymberis made a motion, seconded by Ms. Heineman, to recommend to the Board of Supervisors to approve Sadsbury Park, Phase 3B &4A, contigent the conditions are met with the MacCombie review letter dated October 23, 2017 with the exception of 6 -E. The Planning Commission agrees with Arcadia that the sidewalk remains as proposed in the submittal.  With there being no questions, the members voting “aye”, the motion passed unanimously.

Michael Gill, Esq. came before the Planning Commission asking for a recommendation for Preliminary for Phase 2 of Sadsbury Commons.  The Conditional Use was approved by the Board of Supervisors in 2016.  Mr. Gill stated the square footage of the project was approved by the Board of Supervisors.  He is working with PennDOT on the traffic issues and in discussions with Pennsylvania American on a sewer agreement along with the Mast Family and CVS to extend sewer to Parkesburg, through Sadsbury Crossing; where easement are needed.  In the MacCombie letter dated October 26, 2017, there is a question about park and ride locations.  Mr. Gill stated there will be provisions for 1 park and ride in Phase 2 and another in Phase 3.  Ms. Heineman would like to see park & ride closer, designate 1 or 2 spaces at a restaurant area for ride share, subject to moving it in Phase 3.  Mr. Gill believes the loading dock, which is connected to the building, does not require the 100- foot setback.  The MacCombie letter would have a need to seek zoning relief from the Zoning Hearing Board.  Mr. Gill disagrees.  Mr. Lowry will talk further with Mr. MacCombie.  Mr. Gill stated he will be asking for a waiver on the topography time-line.  Mr. Gill also disagrees that easements must be obtained from downstream property owners to convey stormwater discharge onto or through their property, as the stormwater will flow through PennDOT or Township pipes.  Mr. Lowry stated that the Township Solicitor and MacCombie Engineers are consulting with the matter of stormwater with DEP.  Mr. Hensel stated the view is a big concern to residents in the area of the Town Center.  Mr. Lymberis stated that according to the plans, Phase 1 has a grass medium in center-left turn lane taking up the center area.  He feels it is good to have the medium for people who j-walk to have a refuge.  This is pedestrian safety. Mr. Gill stated he will need input from the traffic engineer anyway, so they will look into the grass medium.  Mr. Gill stated he would like to attain a recommendation of approval and start conversations with the Board of Supervisors with an eye toward approval in January.  Ms. Heineman stated she does not feel a recommendation can be made at this time.  There are too many items that need to be addressed.  She would like to know if it is possible for Jamie MacCombie to come to the meeting in December?  She would also like to have Mr. MacCombie weigh in on the waiver for topography, discuss the waiver of stormwater run off easements.  Mr. Gill will come back to the Planning Commission in December and still target approval in January.

Mr. Lowry stated the Zoning Update Committee (Wayne Grafton) gave some revisions for the Town Center and discussed the map changes. A vote will be needed on these items.

Ms. Heineman made a motion, seconded by Mr. Rivers, to make changes to the Zoning map west of the Piston Poppers, east of Compass Road to C1 and change parcels between the Route 30 by-pass to Business Route 30 north side of Route 30 and south of by-pass to C1.  All parcels that are in the Agriculture Security will remain as RR.  With there being no questions, the members voting “aye”, the motion passed unanimously.

Ms. Heineman made a motion, seconded by Mr. Lymberis to approve the 2017 Zoning Ordinance and authorize the advertisement of the Zoning Ordinance of 2017 with all the changes.  With there being no questions, the members voting “aye”, the motion passed unanimously.

With there being no further business, Mr. Rivers made a motion, seconded by Mr. Sarbaum, to adjourn to meeting.  With there being no questions, the members voting “aye”, the motion passed unanimously.
