Board of Supervisors Regular Meeting Tuesday, June 6, 2023

A regular meeting of the Board of Supervisors of Sadsbury Township was conducted on Tuesday, June 6, 2023 commencing at 7:00 p.m.  Chairman, Mr. Reynolds called the meeting to order.  Present was Supervisor Mr. Moore, and Mr. Taylor via telephone.  Also present was Attorney Winnie Sebastian, attending in place of Township Solicitor, Mr. O’Keefe.  Present was Township Engineer, Mr. Porter, Police Chief Michael Hawley, and members of the community.

A moment of silence and Pledge of Allegiance was observed.

Mr. Reynolds made a motion, seconded by Mr. Moore, to waive the reading of the minutes of the previous meeting.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Public Comment on Agenda Items:  There were no comments.

Police Report:  Chief Hawley reported for the Month of May, there were 460 calls for service.  282 of these calls were patrol calls, 14 calls were out of the Township, which leaves a total of 164 actual calls.  There were 35 traffic encounters and out of these, 14 citations were written.  There were 7 domestic disturbances and no overdoses in May. Mr. Taylor asked the Chief how the DUI count is going.  The Chief stated the DUI count is included in the traffic encounters.  Enforcement has been more vibrant, and there are regular check points in the Township at different locations.  Chief Hawley stated that if anyone wanted to see the whole police report, it is on file with the Township secretary.

Public Works Report:  There was no report.  Mr. Reynolds stated the islands on Route 30 have had plantings done for $2,300.00.  The Public Works department was allotted $3,500 for the plantings.  The Township bought lunch for the workers on the islands, some of which were workers for John Lymberis.  The GaGa ball pit was installed at the Bert Reel Park as an Eagle Scout project.

Emergency Management Report: Mr. Taylor asked if the Sadsburyville Fire Company has been trained on cutting into electric cars.  Mr. Reynolds stated, yes, they all went to class for this.

Keystone Valley Fire Department Report:  For the month of May, 2023, there were a total of 33 incidents for:  fires 9, rescue& emergency medical service 12, hazardous condition, (no fire) 2, service call 4, good intent 1, false alarm and false call 4.  The average personnel per call were 8 people.  The average response time form dispatch to on scene was 7 minutes.  The total man hours were 105 hours and 54 minutes.

The Keystone Valley EMS Service responded to 145 calls for the month of May for: ALS:  back pain 2, CVA/stroke 2, cardiac problems 10,cardiac resp. arrest 5, choking 1, Diabetic emergency 3, emotional disorder 1, equestrian injury 1, fall 2, hemorrhaging 1, hypotension 2, injured person 2, overdose 2, respiratory difficulty 4, seizures 8, syncope 4, unconscious person 4, unresponsive person 1, accident 1.  BLS:  accident 11, accident entrapment 2, accident involving fire 1, accident pedestrian 2, alarm BLS medical 2, carbon monoxide 1, abdominal pain 2, assault with injury 2, back pain 2, DOA 1, emotional disorder 12, fall/lift assist 12, injured person 3, overdose 1, seizures 1, sick person 25, syncope 1, EMS standby event 1, EMS standby fire 6, fire-other type rescue 1.  The response by municipality:  Parkesburg 51. West Sadsbury 23, Highland 15, Sadsbury 36, Sadsbury Township Lancaster County 2, Christiana 6, West Fallowfield 5, East Fallowfield 3, Londonderry 1, Valley 2, Lower Oxford 1.

Sadsburyville Fire Company Report:  For the month of May, Sadsburyville Fire Company responded to 27 calls for service for:  motor vehicle accident 8, automatic fire alarm 7, house fire 5, relocate 3, trash fire 1, mulch fire 1, wires fire 1.  Municipal breakdown:  Sadsbury 15, Valley 4, Caln 3, South Coatesville 2, Coatesville 1, East Fallowfield 1, West Caln 1.  There was an average of 7 firefighters per call.  There were 167 miles traveled, with an average of 602 miles per call.  The time in service was 18 hours and 9 minutes with an average of 40.3 minutes per call.

Westwood EMS Report:  no report.

Planning Commission Report:  Mr. Jessey reported the Planning Commission met on Wednesday, May 10, 2023.  The Planning Commission spent a lot of time planning and discussing the gazebo dedicated to Jane Heineman.  The Planning Commission would also like to have their meetings available on ZOOM.

Engineer Report:  Mr. Porter reported he has an Engineering Escrow release of funds for Lafayette Square Partners, L.P. for Lafayette Square Phase II & III in the amount of $802.50 for the Board’s approval.

Mr. Reynolds made a motion, seconded by Mr. Moore, to approve an Engineering Escrow for Lafayette Square Partners, L.P. for Lafayette Square Phase II & III in the amount of $802.50 per Mr. Porter’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. Porter reported he has an Engineering Escrow release of funds for Sadsbury Associates, LP for Sadsbury Square in the amount of $658.12 for the Board’s approval.

Mr. Reynolds made a motion, seconded by Mr. Taylor, to approve an Engineering Escrow release of funds for Sadsbury Associates, LP for Sadsbury Square in the amount of $658.12 per Mr. Porter’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. Porter reported he has an Engineering Escrow release of funds for Lincoln Crest Management, LLC for Lincoln Crest Mobile Home Expansion in the amount of $2,704.37 for the Board’s approval.

Mr. Reynolds made a motion, seconded by Mr. Moore, to approve an Engineering Escrow release of funds for Lincoln Crest Management LLC for Lincoln Cres Mobile Home Expansion in the amount of $2,704.37 Per Mr. Porter’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. Porter reported he has an Engineering Escrow release of funds for XARIS Property Group, LLC for Sadsbury Park Phase 1, Clover Hill at Sadsbury Park in the amount of $685.00 for the Board’s approval.

Mr. Reynolds made a motion, seconded by Mr. Taylor, to approve an Engineering Escrow release of funds for XARIS Property Group, LLC for Sadsbury Park Phase 1, Clover Hill at Sadsbury Park in the amount of $685.00 per Mr. Porter’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. Porter reported he has an Engineering Escrow release of funds for Sadsbury Arcadia Associates, L.P. for Sadsbury Park Phase 4A in the amount of $473.12 for the Board’s approval.

Mr. Reynolds made a motion, seconded by Mr. Moore, to approve an Engineering Escrow release of funds for Sadsbury Arcadia Associates, L.P. for Sadsbury Park Phase 4A in the amount of $473.12 per Mr. Porter’s recommendation.  With there being no questions from the pubic, the Board voting “aye”, the motion passed unanimously.

Mr. Porter reported he has a Letter of Credit Reduction Certificate of Completion for Lafayette Square Partners, LP for Lafayette Square Phase II & III in the amount of $11,811.20 for the Board’s approval.

Mr. Reynolds made a motion, seconded by Mr. Moore, to approve a Letter of Credit Reduction Certificate of Completion for Lafayette Square Partners LP for Lafayette Square Phase II&III in the amount of $11,811.20 per Mr. Porter’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr.Porter reported Pennsylvania American Water wants approval to supply sewer service to 1143 Octorara Trail through the Sadsbury Commons pumping staton.

Lafayette Square is finishing the community club house.  Dedication of roads in Lafayette Square for Liquid Fuels requires a rite of way and there is none. Will possibly need to open Land Development.  Paving will be done this summer.

Lincoln Crest roads have been base paved.  The Board cannot foresee taking over the roads in Lincoln Crest.

Sadsbury Square is finished up with grading and Pennsylvania American will be adding additional fire hydrants.

Sadsbury Commons has plans to be signed and recorded.  Letters of Credit were combined for WAWA and Wendy;s.  The parking lot has been stoned based.  Around September, they will start building.  The traffic signals at Business Route 30 and Route 10 will be maintained by the Township.  The traffic signal at Nova Way will be maintained by the Township but will be reimbursed by the Developer.

AZ Parkesburg has not made a submission.

Sherwin Williams needs a letter of extension.  Should receive that in a couple days.

Stottsville Inn has an extension to July 6, 2023.   At Bert Reel Park the GaGA ball park has been installed.

The bid package for the fencing at Bert Reel Park will be ready for advertising soon.

Nate MacCombie has a punch list for Sadsbury Park road paving to get roads ready for dedication.

Mr. Jessey asked if Mr. Porter talked to Lincoln Crest about their lighting change.  Mr. Porter said he has not but he will.  Mr. Jessey will get cost estimate for the gazebo for the Board.

Solicitor Report:  Ms. Sabastian stated she has Resolution 2023-10 concerning Sadsburyville Fire Department insurance eligibility.  This would expand the availability of the Workers Comp for more modes of activity for the fire department.  Dave Reynolds should abstain from the vote, as he is a member of the fire department.

John Moore, made a motion, seconded by Mr. Taylor, to adopt Resolution 2023-10 concerning Sadsburyville Fire Department insurance eligibility.  With there being no questions from the public, and Mr. Reynolds abstaining, the motion passed.

Building/Zoning Report:  For the month of May, 2023 for Zoning:  issued 1 permit for temporary fireworks sales tent, issued 1 permit for a deck, issued 2 permits for fences, and answered various phone calls for signs and properties for sale in the Township.

Building:  issued 6 permits for new construction, issued 1 permit for basement renovation, issued 1 demolition permit, issued 1 permit for temporary construction trailer, issued 2 permits for Sadsbury Commons, issued 1 permit for commercial alterations, performed 43 inspections for the month of May, and am in the process of reviewing more plans for Sadsbury Commons.  Complaints:  issued 4 high grass complaints and 2 noise complaints.

Chester County Airport Update:  The Airport Authority met today.  The audit is complete and the airport is in good shape.  A lease agreement has been signed for the restaurant.  They plan to be open for lunch and dinner 7 days a week and serve Craft beers.  The perimeter fence around the airport is pending PENNDOT review.  After some complaints, Mr. Roberts will bring up the timing of the flight school at their next meeting.

Payment of Invoices:

Mr. Reynolds made a motion, seconded by Mr. Taylor, to pay the May 2023 General Fund Invoices in the amount of $203,636.54.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Old Business:

The Township is still in need of an Alternate to the Zoning Hearing Board.

Public Comment:

Chief Hawley stated to the Board that the Westwood EMS service in the Township has been a benefit. The immediate response and stellar service is the best investment of funds for public service.

Connie Ellis of Valley Road in Pomeroy has traffic speeding and safety issues.  Why are there no police on duty after midnight?  Mr. Reynolds replied that funding is not available at this time.

Susan Bankard  asked if the Township makes money on traffic tickets.  It is dangerous at her house.  She would like it on the record that she has not seen any police cars in her area and has not seen anyone pulled over on Route 30.

Chief Hawley stated just because you don’t see us, dosen’t mean we aren’t there.

Chief Hawley also stated that speed signs on state roads are put there by PENNDOT, not the Township.

Mr. Keches asked about line painting on Lieke Road.  Dave Porter stated it is on his list of things to get done.  Dave Reynolds stated it should be done by the end of summer.

Vicki Horan asked what has been done about John Rock noise control.  Dave Reynolds stated he has a meeting with John Rock to look at their plans for noise control.

Michelle Falcone stated that the noise can be heard at 5:30 in the morning.  You can hear the noise from the West Caln site.  Will that also be contained?

Vicky Horan asked since Piasecki will be making drones, will drones be flying over the Township?  Chief Hawley said the drones will be made there and tested on-site. They will not be flying over the Township.

Simon Jessey stated the Noise Ordinance existed in the Township before John Rock.  It states noise ends at 9pm and can begin at 7am.

With there being no further business, Mr. Reynolds made a motion, seconded by Mr. Moore to adjourn the meeting.  With there being no questions from the public, the

Board voting “aye”, the motion passed unanimously.
