Board of Supervisors Regular Meeting, Tuesday, August 6, 2019

A regular meeting of the Board of Supervisors of Sadsbury Township was conducted on Tuesday, August 6, 2019 commencing at 7:00 p.m.  Vice Chairman, John Moore called the meeting to order.  Present was Supervisor Mr. Taylor via telephone, Township Solicitor, Mr. O’Keefe, Township Engineer and Zoning Officer, Mr. MacCombie, and members of the community.  Chairman, Mr. Reynolds was absent.

A moment of Silence and Pledge of Allegiance was observed.

Mr. Moore made a motion, seconded by Mr. Taylor, to waive reading the minutes of the previous meeting.  With there being no questions from the public, the Board voting “aye”, the motion passed.

Kurtis Miller, Constituent Advocate for U.S. Representative Chrissy Houlahan gave a short talk on the accomplishments and items to look forward to being done by the Representative.

Township Police Report:  Chief Ranck reported that for the month of July, 2019, the police patrolled 4,392 miles and answered 382 dispatched incidents along with the State Police who answered 27 incidents during the overnight hours for:  911 hang-up 1, hit & run crash 4, accident motorcycle 1, property damage crash 10, DOA actual or possible 1, alarm police 7, animal complaint 5, assault with injuries 1, assist fire department 2, assist to other police Department 5, burglary 1, business check 131, civil dispute 2, criminal mischief/vandalism 1, disabled vehicle 4, disturbance 3, domestic dispute 1, public intoxication (alcohol/drugs) 1, emotional disorder 1, erratic driver 1, escort person or money 1, fireworks violation 1, for police information 11, house/vacation check 16, keys locked (vehicle, house Etc.) 1, lost property 1, medical emergency 22, miscellaneous police nature 3, missing person 1, noise complaint 6, Township Park check 10, parking violation 1, police report 15, suspicious condition 12, suspicious vehicle 2, theft 3, traffic general hazards 14, trespasser 2, stop traffic 42, and warrant hit or service 3.  There were 5 criminal arrests during the month of July which do not include any crimes that are currently under investigation, which may result in an arrest.

Public Works Report:  For the month of July, 2019, the Public Works performed mowing and weed control on Township owned properties and right-a-ways, maintained vehicles and equipment and inspection and operation of emergency equipment to ensure proper operation in the event of an emergency situation.  All bridges, guard rail, road/street signs, and areas of obscured vision with-in the road right-a-way have been removed of vegetative debris.  Storm drains have been inspected and cleared if warranted.  All street and road signs have been checked for visibility and maintenance if needed.  This month “No Parking Anytime” street signs were installed on the eastern side of Chestnut Street between Spruce and Middle Streets.  These signs were officially installed and as of August 1, 2019 the police were notified of their installation.  The Department also cleaned up and removed several large limbs and numerous small branches and twigs in the rear of Bert Reel Park.  This tree damage was a result of a powerful thunderstorm from a few weeks ago.  The same storm that caused a lot of tree damage in the area of Valley Road and Virginia Avenue, in which the Department assisted PennDOT on clearing at the request of Supervisors Reynolds.  The Department has removed all wood from trucks and trailers.  This wood has been stained and is in the process of being sealed to preserve and give a better appearance.  The Equipment hours were 902 and the vehicle miles were 895.6.

Emergency Management Report:  – Mr. Taylor reported the County is closely monitoring the storms.

Keystone Valley Fire Department Report:  For the month of July 2019, the Keystone Fire Department responded to 16 calls for:  fire 4, rescue/medical assist 4, false 6, service 1, and hazard 1.  The response by municipality is as follows:  West Sadsbury Township 5, Highland Township 0, Parkesburg Borough 6, Sadsbury Township 2, Out of District 3.  The response by personnel average per call was 6 with a total of 82 personnel for combined response hours of 23.14 hours.  The average dispatch time from dispatch to on-scene was 10 minutes.  The fire units traveled 908 miles and used 151.4 gallons of fuel.  The ambulance(s) traveled 2,749 miles and used 301.9 gallons of fuel.  Keystone Valley EMS Division responded to 94 calls for:  treated/transported BLS 30, treated/transported ALS 27, no service required 10, patient refusal 5, treated, transferred care 1, treated and released 14, public service 2, dead at scene 2, recalled 3.  The municipal breakdown is as follows:  Parkesburg Borough 34, Sadsbury Township 33, West Sadsbury Township 13, Highland Township 4, Atglen Borough 2, East Fallowfield Township 2, Sadsbury Township Lancaster County 1, Upper Oxford 2, West Caln 1, And West Fallowfield 2.

Sadsburyville Fire Company Report:  For the month of July 2019, the Sadsburyille Fire Company responded to 26 calls for:  motor vehicle accident 7, assist EMS 3, public service 2, house fire 4, auto fire 2, building fire 2, appliance fire 1, CO alarm 1, pedestrian struck 1, and 1 burning complaint.  The Municipal breakdown is as follows:  Sadsbury Township 13, Valley Township 8, and West Caln Township 5.  There were 162 firefighters responding for an average of 6 firefighters per call.  There were 162 miles traveled for a total of 6 miles per call.  Time in service was 15 hours and 19 minutes for an average of 34.1 minutes per call.

Township Engineer Report:  Mr. MacCombie reported he has a Letter of Credit Certificate of Completion for Sadsbury Arcadia Associates, L.P. for Sadsbury Park, Phase 3A in the amount of $75,304.75 for the Board’s approval.

Mr. Moore made a motion, seconded by Mr. Taylor, to approve a Letter of Credit Certificate of Completion for Sadsbury Arcadia Associates, L.P. for Sadsbury Park, Phase 3A in the amount of $7,5304.75 per Mr. MacCombie’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed.

Mr. MacCombie reported he has an Engineering Escrow release of funds to the Township for Rock Holdings, PA LLC Office Assembly and Manufacturing Facility in the amount of $28.75 for the Board’s approval.

Mr. Moore made a motion, seconded by Mr. Taylor, to approve an Engineering Escrow release of funds to the Township for Rock Holding, PA LLC Office Assembly and Manufacturing Facility in the amount of $28.75 per Mr. MacCombie’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed.

Mr. MacCombie reported he has an Engineering Escrow release of funds to the Township for CTDI Building Expansion Land Development in the amount of $205.62 for the Board’s approval.

Mr. Moore made a motion, seconded by Mr. Taylor, to approve an Engineering Escrow release of funds to the Township for CTDI Building Expansion Land Development in the amount of $205.62 per Mr. MacCombie’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed.

Mr. MacCombie reported he has an Engineering Escrow release of funds to the Township for Sadsbury Arcadia Associates, L.P. for Sadsbury Park Phase 3B in the amount of $230.00 for the Board’s approval.

Mr. Moore made a motion, seconded by Mr. Taylor, to approve an Engineering Escrow release of funds to the Township for Sadsbury Arcadia Associates, L.P. for Sadsbury Park Phase 3B in the amount of $230.00 per Mr. MacCombie’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. MacCombie reported he has an Engineering Escrow release of funds to the Township for Sadsbury Arcadia Associates, L.P. for Sadsbury Park Phase 3A in the amount of $14,918.75 for the Board’s approval.

Mr. Moore made a motion, seconded by Mr. Taylor, to approve an Engineering Escrow release of funds to the Township for Sadsbury Arcadia Associates, L.P. for Sadsbury Park Phase 3A in the amount of $14,918.75 per Mr. MacCombie’s recommendation.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. MacCombie stated the Sadsbury Village Enhancement Project will be out to bid and should have bids in by October or November.  He is doing a review of the Sadsbury Park Phase 1, at the Southwest corner of Quarry Road and Old Wilmington Road owned by John Newton.  The plans for this project have been revised.  He is also in the process of doing a review of the plans for Sadbury Square.  Mr. MacCombie reported that Pennsylvania American will close Valley Road from Newport Avenue to the City of Coatesville to install sewer lines.  The work will be done in 7 or 8 months, around spring next year.

The Landscape Ordinances are going to the Chester County Planning Commission tomorrow for their review.  After that it will need to be advertised two times.  It will be 2 to 3 months before passage.  Mr. Montone of CTDI will submit Landscape plans for CTDI to be ready for approval when Landscape Amendment is adopted.

Township Solicitor Report:  Mr. O’Keefe reported he was asked by the Coatesville Area School District to execute a Memorandum of Understanding which spells out how the school agency and local police would work in harmony together.  Since Sadsbury Township has no school located in the Township, the local police would only handle criminal activity committed on a bus.  Mr. O’Keefe will send agreement to Chief Ranck for signatures.

Mr. Moore made a motion, seconded by Mr. Taylor, to authorize the Chief to execute the Service Agreement and Memorandum of Understanding with the Coatesville Area School District.  With there being no questions from the public, the Board voting “aye”, the motion passed.

Mr. O’Keefe stated that Michael Gill on behalf of Sadsbury Commons has satisfied his escrow agreement for the grading permit.

Mr. Moore made a motion, seconded by Mr. Taylor, to authorize execution of Sadsbury Commons grading permit escrow agreement.  With there being no questions from the public, the Board voting “aye”, the motion passed.

Mr. O’Keefe reported on the progress at 7 Middle Street by saying there is good news and there is bad news.  The bad news is the Judge, after hearing testimony on behalf of the Township, prohibited occupancy.  After Bruce Potter, Jr. showed up and give his testimony, the judge reversed his opinion, and the injunction was dissolved, which means he can occupy the property.  The good news is that the Tax Claim Bureau is executing back tax liens and along with the Township liens, the property will go to Sheriffs Sale around September.  Whoever buys the property must bring the property into compliance with the Township Codes.

Mr. O’Keefe stated he went to the court house to have the signed plans from D&S Developers signed and time limits forced the plans to be signed on Wednesday.  At the July meeting, the Board agreed to extend the D&S time limit, would the Board consider another extension.

Mr. Moore made a motion, seconded by Mr. Taylor to extend the approval period of D&S Developers to Friday, August 9, 2019. With there being no questions from the public, the Board voting, “aye”, the motion passed unanimously.

Planning Commission Report:  No July Meeting.

Chester County Airport Update: Mr. Roberts reported there was no meeting last month.  The Authority met today.  The restaurant is still for sale.  Lockeed Martin will be here for another 2 years.  The Control Tower was cancelled because of the Lockeed matter, but is back on again.  Next Friday is National Aviation Day.

Payment of Invoices:

Mr. Moore made a motion, seconded by Mr. Taylor, to pay the July 2019 General Fund invoices in the amount of $184,062.05.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

Mr. Moore made a motion, seconded by Mr. Taylor, to pay the July 2019 Sanitary Sewer invoices in the amount of $7,901.10.  With there being no questions from the public, the Board voting “aye”, the motion passed unanimously.

New Business:

The Township is in need of 1 Planning Commission member and 2 Zoning Hearing Board members.  If anyone would like to volunteer for any positions, please submit your resume to the Township Secretary.

Public Comment:

Earl Taylor said he is glad to be home.

Simon Jessey stated the lights at CTDI are quite bright and going directly into Sadsbury Park.  Will the landscape cancel them out?  Mr. Montone stated the landscape will not have an effect on the lights, but he will turn them downward.

Vicky Horan wanted to know if the Township will be giving Sadsburyville Fire Company money to purchase equipment.  Earl Taylor replied no.

Vicky Horan stated that at the last meeting Dennis O’Neil would get the minutes for the Route 30 Bypass project meeting.  Mr. MacCombie will talk to Dennis.

Dawn Groff would like to know if the Township is interested in participating in National Night Out next year.  Earl Taylor said it sounds like a good idea.
